988 Suicide Prevention Hotline Implementation and Move to Ten-Digit Dialing:
The FCC has mandated the adoption of a 988 Suicide Prevention Hotline to be Implemented by July 16, 2022. However, to make this change in New Mexico, the state will be required to move to ten-digit dialing for all telephone calls made in the state. On April 24, 2021, the ten-digit permissive dialing period will begin, but seven-digit dialed calls will still complete. On October 24, 2021, ten-digit dialing will become mandatory and seven-digit calls in New Mexico will not complete after that date. The FCC and telephone providers are working diligently to implement this process.

The formal complaints of Windy Jo Ashworth and David Killinger against Running Bear Rescue, Inc. D/B/A Rocky Mountain EMS; and the petition of the Transportation Division of the Public Regulation Commission for immediate suspension of the operating authority of Running Bear Rescue, INC. D/B/A Rocky Mountain EMS to provide ambulance service.
The public hearing in this matter will be held at 9:00 a.m. on Monday, April 12 through April 16, 2021. The hearing will be streamed live on YouTube, and the link will be posted here- Click To Watch. Interested persons who are not affiliated with a party may make oral comment on April 12 only at the 9:00 a.m. start of the hearing. Persons wishing to make an oral comment must register in advance with Ana Kippenbrock at ana.kippenbrock@state.nm.us starting today and no later than 8:00 a.m on April 12. For all rulemaking proceedings, the “Rulemaking Record,” as defined by the New Mexico State Rules Act, is made up of various documents, pleadings, comments, and other information that is readily available through this website. To view the Rulemaking Record for any of the rulemakings listed below, access the Commission’s “Edocket” using the link and guest login information above. Once you are logged in to Edocket, click on the “Documents Search” link on the left side of the screen, under the “Search” heading. On the next screen, enter the case number of the rulemaking in the “Case #” field and click the “Go” button at the bottom of the screen. The next screen will show you all of the documents filed in the rulemaking proceeding – i.e., the Rulemaking Record. PRC Rulemaking laws:
For all its rulemakings the Commission follows the provisions of the Public Regulation Commission Act, NMSA 1978, § 8-8-15 (Commission rules; procedures for adoption). This statute contains requirements for public notice content, pre-hearing notice timing, and notice publication methods, among other requirements. Here is a link to the statute. In addition, the Commission follows the State Records Administrator's rulemaking Rules, 1.24.10 (about the New Mexico Administrative Code) (NMAC 2017) and 1.24.15 (about the New Mexico Register) (NMAC 2017). Here is a link to those Rules.
In addition to these laws, the Commission also follows:
- For Public Utility Act rulemakings, the Commission follows the Rulemaking Procedures Rule 17.1.120 NMAC (2010). This rule sets out the requirements of pre-action notice publication timing and notice content, and provides other specific requirements of procedure. Here is a link to that rule.
- For State Fire Marshal rulemakings for safe vehicular transportation, storage, handling, and use of flammable and combustible liquids, the Commission follows the notice mailing and hearing provisions of NMSA 1978, § 59A-52-17 (which refers to NMSA 1978, § 59A-52-16). Here is a link to those statutes.
- For Transportation Division rulemakings, the Commission follows the notice publication, notice timing, and other provisions contained in NMSA 1978, § 65-2A-6 (A) and (B) (Notice) of the Motor Carrier Act. Here is a link to that statute.
- Finally, for all rulemakings that are not controlled by other procedural laws of the Commission, the PRC will follow the New Mexico Attorney General's proposed rule 1.24.15 (Default Procedural Rule for Rulemaking) (NMAC 2018). Here is a link to that rule. That proposed rule is scheduled to become effective in early 2018.
